Terms of use
Last updated 21 October 2026These terms apply when you use the WIBI website and reports. WIBI is run by [legal entity name, ABN to be added] ("WIBI", "we", "us"). By using WIBI you agree to these terms. If you don't agree, please don't use it.
We've written them in plain English. The short version: WIBI helps you understand a property and what to ask, but it's general information, not advice, and you should check anything important with your own professionals before you sign.
1. What WIBI is
WIBI is an information service for people buying property. For a property address, it brings together public records (such as zoning, planning overlays, hazards, nearby development and infrastructure) and, if you add them, the documents you upload (such as the contract for sale, strata report, and building and pest report).
WIBI uses automated tools, including artificial intelligence (AI), to read those records and documents, summarise what they say, rank what may matter most to a buyer, and suggest questions to ask. Each finding from a document shows the page it came from so you can check it.
2. What WIBI is not
WIBI gives general information only. It does not take your personal objectives, finances or needs into account. In particular, WIBI is not, and does not replace:
- legal advice, or the work of a solicitor or licensed conveyancer reviewing your contract;
- a pre-purchase building, pest or asbestos inspection, a strata records inspection (we don't visit the strata manager or obtain records), or a title search;
- a valuation, or financial, credit, tax or investment advice. WIBI doesn't hold an Australian financial services licence, and figures in a report are information only;
- official certificates, such as a planning certificate under section 10.7 of the Environmental Planning and Assessment Act 1979 (NSW) or a strata information certificate under section 184 of the Strata Schemes Management Act 2015 (NSW).
A report covers only the documents you add and the public records we check, as at the date of the report. If a document is missing pages or records, the report can only say what's there. Records change, so don't rely on a report more than 60 days after its date: run it again with current documents.
Using WIBI does not create a solicitor-client, advisor-client or other professional relationship with WIBI or anyone involved in it. The verdict "Would I buy it?" is a plain-English summary of what we found in the sources we checked, not a recommendation to buy or not buy.
3. AI reading and accuracy
We work hard to make reports accurate: every document finding links to its page, and reports go through automated checks before you see them. Even so, automated reading can miss, misread or misdescribe information, especially in scanned, handwritten, poor-quality or very long documents. See How accurate is WIBI?.
Public records come from government and third-party sources. They can be incomplete, out of date or wrong, and some maps show only approximate boundaries or straight-line distances.
AI can occasionally state something a document doesn't say, mix up documents, or misread numbers and dates. Before you rely on a finding, open the cited page and check it says what the report says. If the original document and the report disagree, the document is right. Reports are produced automatically; a person doesn't review each report before you see it unless we tell you otherwise.
If a report says nothing was found, it means nothing was found in the sources we checked, as at the time we checked them. It doesn't mean the issue doesn't exist. Where we couldn't check something, the report says so and suggests how to check it yourself.
3A. Public records and dates
Each public-record check shows its source and when we last read it. Government data is often published days, weeks or months after events: for example, a development application can be lodged before it appears in the NSW Planning Portal data we copy. Planning maps and controls can change without notice, some councils don't publish every map, maps can be approximate, and distances are usually straight-line.
Zoning, overlays, heritage and nearby development can change after your report date. For the current legal position on a lot, rely on the planning certificate (section 10.7) in your contract and ask your solicitor or the council. If a source stops supplying data or changes its format, a check may be unavailable for a time.
4. Before you rely on a report
Buying property is a major decision. Before you exchange contracts, bid at auction or let a cooling-off period end, you should:
- have a solicitor or licensed conveyancer review the contract and any special conditions;
- get an independent building and pest inspection and, for apartments, a strata inspection report;
- check any finding that matters to your decision against the original document or record, using the page references in your report;
- get advice from your lender, accountant or financial adviser about costs and finance.
Please don't rely on WIBI alone to decide whether to buy, what to pay, or what conditions to accept.
4A. Who may rely on a report
A report is prepared for the account holder (the buyer) and for one property. You may show it to your solicitor, conveyancer, lender, broker, inspector, partner or family to help them advise you, but only you may rely on it. We don't owe a duty to anyone else who reads it, including vendors, agents or later buyers.
5. Documents you upload
You keep ownership of the documents you upload. You give WIBI a non-exclusive licence to store, copy, read and process them, and to use our service providers to do so, for the purpose of producing your report, keeping it available to you and operating the service.
You confirm that you are entitled to share each document with us for that purpose (for example, because the selling agent or vendor gave it to you as a prospective buyer, or you commissioned the report), that sharing it doesn't break any terms or licence the document came with (some inspection and strata reports limit who may use them), and that it doesn't contain anything unlawful. [Lawyer to confirm wording for inspector-owned reports.] Documents often include other people's personal information, such as owners' names in a strata roll. Please only upload documents about a property you're genuinely considering, and use any personal information in them only to assess the property: don't contact, publish or misuse it.
Your documents and reports are private to your account. We don't publish them or show them to other buyers. How we handle personal information is explained in our Privacy policy.
6. Using WIBI fairly
Reports are for your own use in deciding whether to buy a property, and you may share your report with the people advising you. You must not:
- resell, republish or commercially distribute reports or report content;
- scrape, copy or bulk-download the site or its data, or use automated tools to run reports at scale without our written permission;
- try to access another person's report, documents or account, or interfere with the security or operation of the site;
- upload malicious files or content you don't have the right to share;
- copy, reverse-engineer or imitate how WIBI reads documents, checks them or ranks findings;
- use reports or site content to train or test AI models, or to build a competing product.
If you start without an account, we create a private guest session so your documents stay together. Keep any sign-in link or password to yourself. We may suspend access where we reasonably believe these terms have been broken.
6A. Intellectual property
We own the WIBI site, software, check catalogue, report design and wording. You may keep, print and share your report as section 4A allows. Public data in reports remains subject to its owners' licences, including NSW Government and Google terms.
6B. Professional accounts
If you buy reports for clients as a buyer's agent, solicitor, conveyancer, mortgage broker or other professional:
- you may give each report to the client it was prepared for, but not resell it on its own, white-label it, or remove WIBI's name or notices;
- you must give the client the report with its disclaimers and "How to check this" steps intact, and not present it as your own advice or inspection;
- you confirm you have your client's consent to upload their documents and personal information, and you remain responsible for your own professional advice to them;
- volume pricing, payment terms, confidentiality, data handling and liability limits are set out in your professional agreement with us. [Professional agreement to be prepared.]
7. Fees and refunds
Some parts of WIBI are free. Where a fee applies, we show the price before you pay. Prices are in Australian dollars and include GST where it applies.
We'll re-run the report or refund it if: we can't identify the property; a document you added can't be read at all and we can't fix it within 5 business days; or the report has a significant error you tell us about within 30 days and we can't correct it. We'll choose whether to re-run the report or refund it. The report is delivered as soon as it's unlocked, so a change of mind, a decision not to buy, or disagreeing with a report prepared with due care isn't a reason for a refund. This doesn't limit your rights under the Australian Consumer Law, described below.
If something has gone wrong with a report, email us at hello@wibi.com.au and we'll look into it.
8. Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that they will be provided with due care and skill. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have that cannot lawfully be excluded.
9. Limits on our liability
Nothing in this section limits your rights under the consumer guarantees in section 8 or any other right that can't lawfully be limited. Subject to that, and to the extent permitted by law:
- we are not liable for any indirect or consequential loss, or for loss arising from a decision to buy or not buy a property, the price paid, the terms agreed, or a lost opportunity;
- we are not liable for loss caused by errors or omissions in public records, third-party data or the documents you supply;
- where the consumer guarantees allow it, our liability for failing to meet a guarantee is limited to supplying the report again or refunding what you paid for it;
- our total liability for a report is limited to the fee you paid for that report, and for free checks it is nil. Our total liability for all claims is limited to the fees you paid us in the 12 months before the claim arose.
This doesn't limit liability for fraud, or for death or personal injury caused by our negligence.
9A. Your responsibility
You agree to make good loss we reasonably suffer because you uploaded documents you had no right to share, broke section 6, or passed a report on in breach of section 4A or 6B. This doesn't apply to loss caused by our own breach, negligence or misconduct.
10. Third-party information and links
WIBI shows information from NSW Government services, Google Maps Platform and other providers. Their content remains subject to their own terms, and we don't control their accuracy or availability. Links to other websites are provided for convenience.
WIBI is an independent business. It isn't affiliated with, endorsed by or acting for the NSW Government or any council, and a report isn't an official government record or certificate.
10A. Introductions to mortgage brokers
If you ask, and only after you tick the consent box, we send your name, contact details, the property address and the price you entered to [broker business name, ABN, and Australian Credit Licence or credit representative number]. WIBI isn't a lender or broker and doesn't hold an Australian credit licence. We don't give credit advice or recommend any loan.
The broker is independent: they aren't our agent, and they're responsible for their own advice and services. We may receive a fee or commission from the broker if you take out a loan through them. [The amount, or how it's worked out, is shown in the broker's credit guide.] The introduction costs you nothing and you don't have to use the broker.
11. Changes
We improve WIBI regularly, so features and checks may change. We'll give at least 14 days' notice by email or on this site before a material change to these terms takes effect. If you don't agree, you can stop using WIBI and ask us to delete your data. Changes don't affect a report you've already paid for.
12. Governing law and contact
You must be 18 or over and able to make a binding contract to use WIBI.
If there's a dispute, either of us will first give the other written notice and we'll both try for 20 business days to resolve it, including by mediation if we both agree, before starting court proceedings (except where urgent relief is needed).
These terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of that state.
